DEFINITION OF NOT COMPLYING




  • WHATEVER YOU THINK OF FOSTER CARE AND ADOPTION, 

    KEEP IN MIND THAT IT SHOULD BE ABOUT FINDING A HOME 

    FOR A CHILD WHO NEEDS ONE RATHER THAN ABOUT FINDING

     A CHILD FOR A FAMILY THAT WANTS ONE. WHEN THOSE TWO 

    SITUATIONS COINCIDE, ADOPTION IS A WONDERFUL OPTION. 

    BUT WHEN AN EXISTING FAMILY IS TORN APART NEEDLESSLY

     IN ORDER TO CREATE AN ADOPTIVE FAMILY, IT’S CRUEL.

Kevin Norell is one of the newer foster care caseworkers in the Utah Division of Child and Family Services, hired to satisfy child-welfare reform laws and the terms of a recent lawsuit settlement in Utah.

According to Norell, the state asks a lot of parents who want their children returned home. They have to find a job, find housing, " Parents are ordered into therapy, parenting classes, perhaps drug rehabilitation, and they have to find time to visit with their children.
"Even an organized parent WILL have trouble with all that. And many of these parents are anything but organized," says Norell.[1]
The articulated intent of reunification plans may be admirable, however the reality is that many plans are engineered for failure, as the 1991-1992 San Diego Grand Jury explained: Testimony was received regarding the hours of time which must be spent in order to comply with these plans. Defense attorneys have testified that they have told clients that it is impossible for them to work and comply with reunification. Judges and referees were observed, seemingly without thought, ordering parents into programs which require more than 40 hours per week. Frequently, these parents have only public transportation. Obviously, there is no time to earn a living or otherwise live a life. A parent often becomes a slave to the reunification plan.[2]

August 5 2013- Carie Krenik has called family members informing them that GH has not complied and that the rights to her children will be terminated within the week. Family members became enraged with GH for not complying. Lets take a look at what the county has done to correct the conditions of the provable maltreatment. According to all the testimony she required education and that was it.

The list of things she had to accomplish were

Employment (Not possible)
AB provided GH with transportation and 20.00 application fee  to apply for college courses. AB also provided the start up money for GH to start a savings account. 
AB provided 14.00 and transportation to apply for Minnesota ID
AB provided transportation to the hope center to get a phone. 

COUNTY SERVICES OFFERED TO CORRECT CONDITIONS
Sally Schroer informed GH that the maltreatment on her record would prevent her from working as a CNA. GH then requested job training and or job search classes or services from the Le Sueur County case worker Sally Schroer and she was Negligent to respond. 

Housing
AB is familiar with local resources and provided transportation to city hall so GH could apply for  section 8 housing. AB Also suggested she fill  out applications for every low income apartment to get on the waiting list. (done) 
AB provides temporary housing for GH in the mean time.

Le Sueur County  Sally Schroer cut section 8 housing services after 1 1/2 months which was helping her with rent. GH went homeless in February. GH requested help to prevent the homelessness from Child protection worker Sally Schroer, and she responded to GH's request by telling her (I AM DONE HELPING YOU) and documented that it was probably a good thing that GH lost her home. 

GH again requested assistance for housing a second time from County case worker Sally Schroer while staying with AB, and Sally Schroer was negligent to respond.

Complete another round of out patient treatment for marijuana after completing in patient treatment. (Done)

Out patient Treatment was started but could not be completed under the limited timeline that came with the judges ruling of a Termination of parental rights (TPR) The 2nd round of treatment for GH formerly using marijuana (a physically non addictive drug) was not compatible with completing the other tasks on her list and also not compatible for the number of days GH was required to miss for her termination of parental rights hearing. She had 30 days. An  emergency court hearing and Sally Schroer caused delays in her initial start date. 

 Treatment was 3 days a week plus AA/NA meetings and domestic violence support group. She was told by the drug treatment counselor that her 7 absences were part of the reason she could no longer help her at fountain centers in Faribault. Five of GH absences were the result of her required presence in court. She cannot miss termination of parental rights hearings for treatment.
 Treatment said that she cannot miss treatment to attend termination of parental right hearings. 

 She was sent home early on in her treatment for taking care of her dental needs. GH's teeth require extensive dental repair. Getting her teeth fixed  is on the list of recommendations created by the county. A tooth abscessed and GH had to make and emergency appointment to get the tooth treated because she was in so much pain. The dentist pulled the tooth and prescribed pain medication.  Gh informed the treatment counselor and she was sent home with a lecture about drug seeking behavior and that she cannot use pain medication.

Another item on GH's list was psycho therapy. The appointment to establish care was set up before the schedule for treatment was implemented. The termination of parental rights hearings forced her to skip treatment to go to this appointment because if it was rescheduled it would have taken another three to four weeks to get another appointment which GH did not have with the fast approaching termination of parental rights.  

 The treatment counselor Jasmine who is helping GH with her duo diagnosis said if GH required medication for her C-PTSD then they also could not help her.  Getting psycho therapy for the C-PTSD is on GH's list of recommendations from the county.  

  The case worker Sally Schroer  was  responsible for getting the paperwork done so information could be passed from In patient Fountain Centers in Albert Lea to the halfway house west hills lodge in Northfield. Sally Schroer was a NO CALL NO SHOW for the meeting in Albert Lea to complete the discharge paper work. So the care list  for GH  was not provided from one placement to the other. 



The result was information did not get transferred for follow up care. The missing follow up care also took part in why GH was asked to leave West Hills Lodge half way house in Northfield,  MN. 
Other reasons were slouching defined as aggressive body language and rolling eyes at a peer.

Le Sueur County offered nothing in terms of correcting conditions as to why the children were taken. Not one single parenting class... The foster care people have received parenting classes they took over for the mother once she was displaced as a result of homelessness.

Neurological Psychological evaluation (Done)

Le Sueur County Sally Schroer tried to have the testing completed against the recommendations of the doctor. 


Neurological Psychological evaluation: 
This was done as much as it could be. The only other place for this type of testing other than St peter was Mayo clinic in Rochester  MN.  Rochester informed GH that she would need a doctor to make a referral which was done. The Doctor would also need to base the referral on some type of medical cause that would require this type of testing. Some examples Mayo gave were head injury, seizures, brain tumors and dementia. If it was not a doctor with out a supporting cause they could not complete the testing.

The vendor that is used for Child protection services is ST Peter.  GH was picked up at fountain centers so she could be transferred to West Hills Lodge in Northfield by AB. The staff told GH if you have the exam done do not use the county vendor. You'r case worker is not trying to help you. Its important it be done by an independent. This is in AB's notes that she witnessed the warning.


It was not physically possible for her to do what they asked

Carie also did not tell the family it was not physically possible for GH to complete the tasks. Based on the time line and the fact that treatment was incompatible with the other requirements. AB tried to work with GH to set up scheduled AA/NA meetings to meet the three times a week.  GH sent it to the case worker who Scheduled visitation over her AA/NA meetings.

At this point GH just sent a letter to her Lawyer explaining that she notified Schroer about when she could attend meetings and she scheduled visitation over one of the times she had to go. So if there is any backlash about it from anyone they will need to see Sally Schroer. If I have to choose between an AA meeting and seeing my kids, I will choose my kids over the meeting.

Another conflict was, GH did not know if she was going to get to sign up for school because the placement exam is on a set date and time. The exam was conflicting with her treatment. She managed to take the exam on the very last day it was offered to start school for the fall semester. It would not have happened had treatment not kicked her out. Both testing and treatment had rigid rules. It was one or the other.


According to AB's notes the amount of time it took to coach GH through this process was worse then a full time job. AB said it is exhausting and stressful. AB and GH were pulling their hair out trying to make the reunification plan work when it was not humanly possible!!


How did the county help to reunify
Foster parents took over parent child therapy once Sally helped her go homeless and sent the mother away for a month for a drug that is legal in 18 states and not physically addictive. According to Minnesota law it says the drug use must be related to the maltreatment. This was not the case. GH was not high when Sally took her babies. There was no marijuana in her home there was no drug paraphernalia in the home either. If she had not tested positive for THC the worker would have never known she used marijuana when the kids were at grandma's .

All the parenting specialists and psychiatrists said the reason she left the children alone for the 15 minutes was a result of never having a good role model herself when she was a child. They indicated all she needed was a parenting class. They do not question that she loves her children, her home was clean, the children were clean and there was plenty of food.

NO PARENTING EDUCATION HAS EVER BEEN OFFERED BY THE COUNTY WHICH WOULD HAVE CORRECTED THE CONDITION THEY WERE TAKEN.
